This document sets out general rules for applying Flowers Place legal documents, permitted liability limits and specific features of fresh flower goods.
1. Purpose of this document
This document applies to all Flowers Place website pages, orders, correspondence, the public offer, refunds policy, privacy policy, cookie policy and website terms of use.
If a specific Flowers Place document regulates an issue in more detail, that specific document applies. If a mandatory legal rule provides otherwise, the mandatory legal rule applies.
The Russian version of the documents prevails over translations, interface labels and auxiliary explanations in other languages.
2. Informational nature of website materials
Website information, including photos, descriptions, prices, categories, recommendations, timing and availability, is provided for selecting goods and placing orders. It is not a guarantee of unchanged product appearance unless expressly agreed by the parties.
Flowers, plants, packaging and decorative elements may differ in shade, variety, bloom, size, shape and design details due to seasonality, local partner availability and the nature of living goods.
If an obvious technical error is found on the website or in correspondence, Flowers Place may clarify order terms before confirmation or offer a correct performance option.
3. Liability limits
Flowers Place is liable for direct actual damages caused by its fault to the extent permitted by applicable law. If a mandatory legal rule prohibits limitation of liability or grants the consumer broader rights, such rule prevails.
Flowers Place is not liable for indirect losses, lost profit, emotional expectations, reputational consequences, inability to use the website or delays unless such consequences are caused by a culpable breach by Flowers Place and unless exclusion of such liability is permitted by law.
Liability may be limited to the value of the specific order in relation to which the breach occurred, unless another limit is established by mandatory law.
4. Customer-side or recipient-side circumstances
Flowers Place is not liable for impossibility or deterioration of performance caused by an inaccurate address, incorrect phone number, recipient absence, access ban, recipient refusal, lack of pass, unagreed transfer to third parties or failure to follow care rules after delivery.
If the customer asks to leave the order at the door, reception, security, concierge, neighbour or another person, risks after such agreed handover are assessed with regard to the circumstances and applicable law.
The customer is responsible for the lawful transfer of recipient personal data to Flowers Place and for the accuracy of data needed for delivery.
5. Partners and third parties
To perform orders, Flowers Place may involve local shops, florists, courier services, telecom operators, technical contractors and other partners.
Flowers Place is responsible for selecting and coordinating partners within its obligations to the customer, but is not liable for independent third-party actions outside reasonable control where such liability is not imposed by mandatory law.
If an issue is connected with a partner, Flowers Place reviews the customer’s request and takes reasonable measures to settle the situation.
6. Force majeure and technical failures
The parties are released from liability for non-performance or delay caused by force majeure: natural disasters, military actions, emergencies, epidemics, acts of authorities, border closures, sanctions, strikes, accidents, communication, power, hosting or transport infrastructure failures.
When such circumstances occur, the affected party notifies the other party within a reasonable time and proposes a possible option for performance, postponement, partial refund or cancellation with regard to actual expenses and mandatory consumer rights.
Technical failures of the website, messengers, communications or bank transfers are not considered a Flowers Place breach if they are outside reasonable control of Flowers Place.
7. Relationship between documents
The Flowers Place legal documents apply together. In case of inconsistency between general provisions and specific offer, refund or privacy terms, the specific document applies to the relevant issue.
If any provision is held invalid or unenforceable, the remaining provisions remain effective to the maximum extent permitted by law.
Updating one document does not require simultaneous update of all documents if their meaning remains consistent.
8. Mandatory consumer rights
Nothing in the Flowers Place documents is intended to waive consumer rights that cannot be limited under the laws of Kazakhstan, the Russian Federation or another applicable jurisdiction.
If the user is a consumer and mandatory law grants additional guarantees, periods, remedies or refund rules, those rights apply regardless of website wording.
